Rekindle Terms of Service

Rekindle (“Rekindle,” “Rekindle Now,” “we,” “us,” or “our,” as the context requires) operates and provides the Rekindle websites, applications, digital products, technologies, tools, and online platform (collectively, the “Rekindle Platform”). The Rekindle Platform includes all content, guides, resources, listings, profiles, hobby recommendations, and communications tools offered through rekindle or rekindlenow on web or social platforms.

These Terms of Service (these “Terms”), together with any documents incorporated by reference (including the Rekindle Privacy & Cookie Policy), constitute a legally binding agreement between you and Rekindle, governing your access to and use of the Rekindle Platform. By accessing, registering for, or using the Rekindle Platform, or by clicking “I accept,” “I agree,” or similar, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Rekindle Platform immediately.

PLEASE READ THESE TERMS CAREFULLY. AMONG OTHER THINGS, THEY CONTAIN AN ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTION RIGHTS (SEE SECTION 25).

I. Overview of Services

Rekindle is a digital hobby exploration platform designed to help individuals discover or rediscover hobbies through curated Guides, digital educational materials, and optional virtual interactions with experienced hobbyists (“Hobby Buddies” or “Buddies”). Buddies may offer virtual conversations, digital guidance, equipment suggestions, creative feedback, or other non-physical, informational support (“Buddy Services”).

Rekindle does not offer or facilitate in-person activities. All Buddy Services are strictly virtual unless the user independently initiates or arranges an in-person interaction outside the Rekindle Platform, which Rekindle does not endorse, supervise, or assume any responsibility for.

Members who engage with the Rekindle Platform, including browsing Guides, interacting with Buddies, or using any digital tools, are referred to collectively as “Members.”

II. Member Responsibilities and Assumption of Risk

1. Virtual-Only Platform

The Rekindle Platform is designed exclusively for online, virtual, informational interactions. Buddies may provide:

  • Tutorials
  • Guidance
  • Suggestions
  • Feedback
  • Resource recommendations
  • Digital Q&A

Rekindle does not supervise or manage any relationships formed through the Platform.

If a user and a Buddy independently choose to meet in person or engage in off-platform activities, they do so entirely at their own risk. Rekindle does not endorse, facilitate, verify, monitor, or assume responsibility or liability for such interactions.

2. Safety and Guide Accuracy

Rekindle provides Guides, lists, and suggestions created by Buddies or other contributors. While we aim to provide helpful information, we do not verify all information, nor do we guarantee its completeness, safety, suitability, correctness, or reliability.

By using the Platform, you acknowledge:

  • Guides may contain errors, outdated information, subjective opinions, or personal methods.
  • Buddies may not be certified instructors or formally trained professionals.
  • You must exercise your own independent judgment before attempting any hobby-related task.
  • Certain hobbies may involve physical, financial, or emotional risks.

You assume all risks associated with attempting a hobby or following any guidance provided through the Rekindle Platform.

3. No Background Checks

Rekindle does not conduct background checks, identity verification, credential verification, criminal screening, or qualification checks on Buddies or Members. Any decision to interact with a Buddy is solely your responsibility.

Rekindle is not responsible for:

  • The accuracy of a Buddy’s profile
  • Misrepresentations by Members
  • The conduct of any Member online or offline

Members must use sound judgment and take appropriate precautions.

4. Disclaimer for Digital Guidance

As a platform, we do our best to provide accurate information and make your experience seamless. However, we do not verify every detail, and we do not background check every Buddy who participates on our site. It is up to the Buddies to provide accurate, up-to-date information. III. Using Rekindle

5. Registration and Accounts

To access certain features, Members may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your credentials
  • Notify us immediately of unauthorized access
  • Not create more than one account or impersonate any person

You are responsible for all activity under your account.

6. Prohibited Conduct

You agree not to:

  • Engage in illegal activity
  • Harass or harm Buddies or Members
  • Provide false or misleading information
  • Attempt to solicit Buddies off-platform for alternative services
  • Request or provide in-person services through Rekindle
  • Circumvent Platform tools, fees, or protections
  • Scrape, hack, disrupt, or interfere with the Platform
  • Upload malicious software
  • Misuse other Members’ personal information
  • Violate intellectual property laws

Violations may result in account suspension or termination.

IV. Buddy Services

7. Nature of Buddy Services

Buddies provide virtual informational support only. They do not provide:

  • Coaching requiring licenses
  • Professional advice
  • Therapy
  • Medical guidance
  • Physical training or instruction
  • In-person lessons

Rekindle is not responsible for:

  • Quality or accuracy of Buddy Services
  • Delays or misunderstandings
  • Outcomes, injuries, or damages resulting from advice or guidance

8. Contracts Between Members and Buddies

When you engage with a Buddy, any resulting arrangement is a direct understanding between you and the Buddy. Rekindle is not a party to any agreement.

Rekindle:

  • Does not supervise Buddies
  • Does not control their methods
  • Does not endorse any Buddy
  • Does not guarantee any outcomes

V. Guides, Recommendations, and Affiliate Links

9. Third-Party Resources

Guides, Buddy profiles, or platform content may contain links to:

  • Product pages
  • Stores
  • Tutorials
  • Courses
  • Tools
  • Equipment suppliers
  • Articles or external websites

Rekindle does not guarantee:

  • Safety
  • Accuracy
  • Legitimacy
  • Availability
  • Quality
  • Pricing
  • Suitability

Using third-party sites is entirely at your own risk.

Rekindle is not responsible for:

  • Purchases, refunds, or returns
  • Product defects
  • Injuries or damages from equipment
  • Misleading information on external sites

You must review the third-party’s own terms, warranties, and privacy policies.

10. Affiliate Links

Some Buddies may use affiliate links. This means:

  • A Buddy may earn a commission if you make a purchase
  • Rekindle does not receive these commissions unless explicitly stated
  • Affiliate links do not imply endorsement by Rekindle

You acknowledge that:

  • Buddies may benefit financially from recommendations
  • You should evaluate recommendations independently

VI. Fees and Payments

11. Payments for Buddy Services

If Rekindle enables paid digital sessions in the future:

  • Fees will be shown before purchase
  • Refund policies will be outlined separately
  • Rekindle may charge platform fees

Until that feature is enabled, all interactions are either free or handled outside Rekindle’s payment infrastructure.

12. No Guarantees of Availability

We do not guarantee:

  • Buddy availability
  • Platform uptime
  • Uninterrupted service
  • Error-free functionality

Rekindle may modify, suspend, or discontinue features at any time.

VII. Intellectual Property

13. Platform IP

Rekindle owns:

  • Website content
  • Branding
  • Logos
  • Designs
  • Guides produced in-house
  • Platform layout and architecture

You may not:

  • Copy
  • Modify
  • Distribute
  • Reproduce
  • Reverse-engineer
  • Frame
  • Sell
  • Commercialize

any part of the Rekindle Platform without written permission.

14. Member-Submitted Content

Members may submit:

  • Profile information
  • Photos
  • Suggestions
  • Feedback
  • Comments

By submitting any content, you grant Rekindle a worldwide, royalty-free license to:

  • Use
  • Display
  • Reproduce
  • Adapt
  • Distribute
  • Publish

for the operation and promotion of the Platform.

VIII. Disclaimers, Limitation of Liability, and Indemnification

15. No Warranties

The Rekindle Platform is provided “as is” and “as available.” We make no warranties, express or implied, including:

  • Accuracy
  • Reliability
  • Safety
  • Suitability
  • Performance
  • Availability
  • Non-infringement

Using the Platform is at your sole risk.

16. Limitation of Liability

To the fullest extent permitted by law, Rekindle is not liable for:

  • Injuries, losses, or damages arising from hobby activities
  • Actions or omissions of Members or Buddies
  • Off-platform interactions
  • Third-party websites or purchases
  • Errors or outdated information in Guides
  • Cyberattacks, outages, or technical failures
  • Decisions you make based on information on the Platform

Our total liability shall not exceed USD $100.

17. Indemnification

You agree to indemnify and hold harmless Rekindle, its affiliates, owners, employees, contractors, and partners from any claims, losses, damages, injuries, or liabilities arising from:

  • Your use of the Platform
  • Your interactions with Buddies
  • Your reliance on Guides or recommendations
  • Your use of third-party products
  • Your violation of these Terms

IX. Termination

18. Termination by Rekindle

We may suspend or terminate your account at any time, with or without notice, including if you:

  • Violate these Terms
  • Engage in harmful, fraudulent, or illegal activity
  • Misuse the Platform

19. Termination by You

You may delete your account at any time.

Termination does not affect:

  • Surviving obligations
  • Our right to enforce prior conduct

X. Dispute Resolution

20. Governing Law

These Terms are governed by the laws of the State of Massachusetts, United States, without regard to conflict-of-law principles.

21. Arbitration Agreement

Most disputes must be resolved through binding individual arbitration rather than court. You waive your right to:

  • Jury trial
  • Class actions
  • Representative actions

Certain claims (e.g., IP issues) may be brought in court.

XI. Miscellaneous Provisions

22. Third-Party Services, WordPress, and Plugins

The Rekindle Platform may rely on:

  • WordPress
  • WordPress plugins
  • Third-party APIs
  • Payment processors (if used in the future)

These services have their own terms and privacy policies. Rekindle is not responsible for:

  • Their operation
  • Their behavior
  • Their data practices
  • Their uptime
  • Their accuracy

Your use of the Platform acknowledges these dependencies.

23. Entire Agreement

These Terms constitute the entire agreement between you and Rekindle.

24. Severability

If any provision is found unenforceable, it is severed and the rest remain valid.
